the-dukeCan you sue a dead company? Apparently you can, since that’s exactly what Take Two is doing to the recently shut 3D Realms. The reason? Well, Duke Nukem Forever. Apparently, 3D Realms didn’t really work 100% on the game and it never hit the stores. No s**t!

According to Bloomberg, Take Two Interactive states that “Apogee continually delayed the completion date for the Duke Nukem Forever. Apogee repeatedly assured Take-Two and the video-gaming community that it was diligently working toward competing development of the PC Version of the Duke Nukem Forever”

The publishers state that they paid $12 million for the publishing rights of the game back in 2000 and signed a new agreement in 2007. Obviously, Duke Nukem Forever never made it out. Still, at the moment it is unknown what damages is Take Two asking from 3D Realms, but I do hope that the current state of DNF is there and they’ll continue with the development. I would hate this DNF joke to end in such a trashy manner…
